Marriage is Not a License to Rape, Bombay HC Reads Down Exception 2 to Section 63 BNS

Aanya M. v. State of Maharashtra & Anr., Crl. Writ Petition No. 412/2026 · Decided May 7, 2026

In a landmark 286-page judgment, a full bench led by Chief Justice Devendra Kumar Upadhyaya has read down the marital rape exception, holding that consent in marriage cannot be presumed perpetually and that bodily autonomy is a non-negotiable constitutional guarantee under Articles 14, 15, 19, and 21 of the Constitution.

Founded in a Delhi hotel room

Rohit Sharma and two colleagues launched Nyayvidhan from a borrowed laptop. First week's traffic: 47 readers. Most were family members.

2016
First Supreme Court accreditation

After two years in the press gallery, Nyayvidhan received formal SC accreditation — the first purely digital legal publication to do so.

Puttaswamy live-blog breaks records

Our live coverage of the nine-judge bench brought 280,000 readers in a single day and put Nyayvidhan firmly on the national map.

2019
High Court network launched
